Agreement
These Terms of Service (“Terms”) govern your access to and use of Porta.pics (the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
Porta.pics is an online community for sharing and browsing user-submitted photos and related information. We may change, suspend, or discontinue features at any time. We do not guarantee uninterrupted or error-free operation.
Eligibility
You must be old enough to form a binding contract where you live and meet any minimum age we specify (for example, not under 13 in the United States). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
Accounts
You are responsible for your account credentials and for activity under your account. You must provide accurate information and keep it reasonably up to date. You may not share account access in ways that violate these Terms or compromise security.
User content
You retain rights in content you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and create technical copies (including thumbnails and backups) as needed to operate, promote, and improve the Service, and to enforce our policies. You represent that you have the rights to grant this license for your content.
You understand that other users may view, share, and interact with content you make public according to product features.
Acceptable use
You agree not to:
- Violate applicable law or infringe others’ rights (including privacy, publicity, and intellectual property);
- Harass, threaten, or harm people or groups;
- Upload malware, attempt unauthorized access, or disrupt the Service;
- Scrape or collect data from the Service in bulk without our permission;
- Misrepresent your identity or affiliation;
- Use the Service to build a competing product through systematic extraction of our data or users’ content.
Moderation
We may review, remove, refuse, or limit content or accounts for any reason, including to enforce these Terms, comply with law, or protect the community. We are not obligated to monitor all content. Different visibility rules (for example, approval workflows) may apply depending on how the Service is configured.
NSFW and sensitive content
The Service may allow marking or filtering content that is not suitable for all audiences. You are responsible for tagging content appropriately where the product provides that option. We may still remove or restrict content at our discretion.
Third-party services
The Service relies on third parties (for example, authentication, hosting, storage, and maps or place search). Your use of those features may be subject to third-party terms and privacy policies. See also our Privacy Policy.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (IF YOU HAVE NOT PAID US). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Indemnity
You will defend and indemnify us and our affiliates, directors, employees, and agents against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms, to the extent permitted by law.
Termination
You may stop using the Service at any time. We may suspend or terminate your access for conduct that we believe violates these Terms or harms the Service or others. Provisions that by their nature should survive will survive termination (for example, licenses you granted for content already distributed, disclaimers, and limits on liability).
Changes
We may modify these Terms from time to time. We will post the updated Terms and update the “Last updated” date. If changes are material, we may provide additional notice where practical. Your continued use after changes become effective constitutes acceptance of the revised Terms, to the extent allowed by law.
Governing law
These Terms are governed by the laws of the jurisdiction we designate for disputes, excluding conflict-of-law rules. Courts in that jurisdiction will have exclusive venue, unless applicable law requires otherwise. Replace this paragraph with your chosen jurisdiction after legal review.
